Terms and Conditions

Refund/Cancellation Policy

Effective Date: January 14, 2025

This Refund/cancellation Policy is incorporated into and governed by the Terms and

Conditions of CM Pro Photo. By booking services, placing an order, or entering into a

school photography agreement, the school, parents, and students agree to the terms

outlined below.


1. General Policy

All purchases made with CM Pro Photo are final and non-refundable, except where

required by applicable law or expressly approved in writing by CM Pro Photo.

This policy applies to, but is not limited to:

• School portrait sessions

• Sitting or session fees

• Printed photographs and products

• Digital images or downloads

• Retakes, reprints, background changes, and specialty items

Once photography services have been performed or an order has been submitted to

production, no cancellations, refunds, or credits will be issued.


2. School Contracts & School Portrait Programs

For school-contracted photography services:

• Sitting or session fees cover photography services only and do not include prints

or digital images unless explicitly stated in writing.

• Portrait orders placed by parents or guardians are individual retail transactions and

are not refundable once submitted to production.

• CM Pro Photo is not responsible for dissatisfaction based on personal preference,

including but not limited to facial expression, pose, hairstyle, wardrobe, or

background selection.

• Once portrait files are submitted to the school for yearbook or administrative use,

no refunds will be issued for those services.

The school acknowledges and agrees that CM Pro Photo’s liability for any allegedly

defective service or product is strictly limited as stated in the Terms and Conditions.


3. Limited Exceptions

Refunds or replacements may be considered only in the following limited circumstances

and solely at the discretion of CM Pro Photo:

• Verified Production Defects: If a printed product contains a confirmed production

error, CM Pro Photo may offer a reprint or refund for the affected item only.

• Duplicate or Erroneous Charges: If an incorrect charge is confirmed, a refund may

be issued for the duplicated amount.

• Service Non-Performance: If CM Pro Photo is unable to perform contracted

services due to circumstances entirely within its control, a refund or credit may be

considered.

All refund or replacement requests must be submitted within 21 days of receipt of the

product or service. Requests submitted after this period will not be considered.


4. Destruction Requirement for Refunds or Reprints

In cases where a refund or reprint is conditionally approved, CM Pro Photo may require

proof that the entire original order has been destroyed. Destruction must render each

print unusable, typically by cutting each print completely in half, just once.

If prints are shredded, excessively cut, or otherwise destroyed in a manner that

prevents CM Pro Photo from identifying the specific image or product, we will be

unable to verify the item in question. In such cases, no refund or reprint will be issued.

All destruction must be performed exactly as instructed and must clearly show the original

image and product size while rendering the print unusable.

Failure to comply with destruction requirements may result in denial of a full refund and

issuance of a partial refund or reprint at CM Pro Photo’s discretion.


5. Refund Review Process

Upon receipt of a refund request:

• CM Pro Photo will review the request and supporting documentation.

• Determination will be made within 10 business days.

• Approved refunds will be issued to the original payment method. Processing times

may vary depending on financial institutions and payment processors.

CM Pro Photo is not responsible for delays caused by third-party payment providers.


6. Chargebacks

Initiating a chargeback without first contacting CM Pro Photo to resolve the issue is a

violation of this Refund Policy and the Terms and Conditions.

CM Pro Photo reserves the right to:

• Dispute chargebacks

• Provide documentation to financial institutions

• Refuse future services to individuals or schools involved in chargeback abuse


7. Policy Modifications

CM Pro Photo reserves the right to modify or update this Refund Policy at any time.

Changes take effect immediately upon posting. Continued use of CM Pro Photo’s services

constitutes acceptance of the updated policy.


8.Ownership of Images

All images taken during the photo session are the property of CM Pro Photo

Permission for Use

CM Pro Photo has the right to use the images for promotional purposes, including but not limited to:

Print advertising

Website and social media

Studio displays

Marketing materials

You understand that no monetary or other compensation will be provided for the use of these images for promotional use.


Opt-Out Option

If you prefer to opt out of this release and restrict the use of your images for advertising purposes, you may notify us via email at CustomerServiceCMProPhoto@outlook.com Opt-out requests must be submitted within 30 days of the session date.
